1. ACCEPTANCE OF TERMS
By accessing zaxxanmed.com (the "Site"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Site. Zaxxanmed may modify these Terms at any time. Continued use constitutes acceptance.
2. INTELLECTUAL PROPERTY
All content on the Site (text, graphics, logos, images, videos) is owned by Zaxxanmed or its suppliers and protected by copyright and trademark law.
"Zaxxan" and "Zaxxanmed" are registered trademarks of Muhammad Faiez Jamal.
You may view and print Site content for personal, non-commercial use only. You may not reproduce, distribute, or sell Site content without written permission.
3. MEDICAL DEVICE DISCLAIMER — CRITICAL
3.1 Class I Medical Device Classification
The Zaxxan 01 otoscope is classified as a Class I medical device under U.S. FDA regulations.
3.2 NOT a Surgical Instrument
THE ZAXXAN 01 CANNOT BE USED AS A SURGICAL INSTRUMENT AND IS NOT INTENDED FOR SURGICAL ENVIRONMENTS.
3.3 NOT for Treatment or Prevention
THE ZAXXAN 01 IS NOT INTENDED TO:
- Treat, cure, mitigate, or prevent any disease
- Provide medical or clinical advice
- Replace professional medical devices in regulated healthcare settings
- Be used in sterile or surgical environments
- Be used as a substitute for professional medical evaluation
3.4 Educational and Personal Use Only
The Zaxxan 01 is designed for educational, professional non-surgical, and personal examination purposes only.
3.5 Always Consult a Healthcare Provider
FOR ANY MEDICAL CONCERN, DIAGNOSIS, OR TREATMENT, ALWAYS CONSULT A LICENSED HEALTHCARE PROFESSIONAL. THE ZAXXAN 01 IS NOT A SUBSTITUTE FOR PROFESSIONAL MEDICAL CARE.
3.6 Product Warranty
The Zaxxan 01 includes a one-year (12-month) warranty on parts and materials from the date of purchase against manufacturing defects. Zaxxanmed makes no warranty regarding medical accuracy, diagnostic reliability, or clinical outcomes. For warranty claims, contact sales@zaxxanmed.com.
4. PRODUCT SPECIFICATIONS & PERFORMANCE
4.1 Specifications Subject to Change
All product specifications (magnification, IP67 rating, optical accuracy, weight, materials, images, pricing) are subject to change without notice and are provided "as is."
4.2 Results May Vary
Performance, durability, and accuracy may vary based on user experience, product condition, environmental conditions, and usage patterns. We make no guarantee that the product will perform identically for all users or in all environments.
4.3 Image Disclaimer
Product images on this Site are subject to change without notice. Actual products may differ slightly from images shown. We are not liable for discrepancies between images and actual products, or between images on this Site and images on Amazon or other retail platforms.
5. WARRANTY DISCLAIMER
5.1 "AS IS" Provision

5.2 No Product Warranty Beyond Section 3.6
Zaxxan 01 otoscopes include the 12-month manufacturer warranty described in Section 3.6, covering parts and materials against manufacturing defects. Beyond that warranty, the product and Site are sold with no additional express warranty. Retailer-specific policies (Amazon, Walmart, etc.) may also apply. For warranty claims, contact sales@zaxxanmed.com; for retailer return policies, refer to your purchase receipt.
6. LIMITATION OF LIABILITY
6.1 No Liability for Misuse
ZAXXANMED IS NOT LIABLE FOR ANY MISUSE, IMPROPER USE, OR UNAUTHORIZED USE OF THE ZAXXAN 01 OR THIS SITE, REGARDLESS OF CONSEQUENCE.
6.2 User Assumes All Risk
YOU ASSUME ALL RISK ASSOCIATED WITH USE OF THE SITE, PRODUCTS, AND ANY OUTCOMES OR DAMAGES.
6.3 No Liability for Damages
IN NO EVENT SHALL ZAXXANMED BE LIABLE FOR DIRECT, INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, LOSS OF PROFITS, INJURY, OR ANY DAMAGES ARISING FROM YOUR USE.
6.4 Liability Cap
OUR MAXIMUM LIABILITY IS LIMITED TO THE PURCHASE PRICE OF THE PRODUCT (OR $100, WHICHEVER IS LESS), OR IF NO PURCHASE, $0.

8. AMAZON & WALMART SALES

- Zaxxanmed is not liable for retailer errors, shipping issues, or fulfillment problems
9. INDEMNIFICATION
You agree to indemnify and hold harmless Zaxxanmed and Muhammad Faiez Jamal from any claims, damages, losses, or expenses arising from your use of the Site, products, violation of these Terms, or your misuse of the product.
10. GOVERNING LAW & DISPUTE RESOLUTION
Governing Law: These Terms are governed by California law.
Binding Arbitration: You and Zaxxanmed agree to resolve all disputes through binding arbitration under American Arbitration Association (AAA) rules in California, rather than in court.
Class Action Waiver: You waive your right to participate in class action lawsuits. All disputes must be resolved individually.
No Jury Trial: By accepting these Terms, you waive your right to a jury trial.
